Can Your Irish Work Permit Be Affected After Approval? What WRC Can Check

Your Work Permit Is Approved. But Compliance Does Not Stop There.

Getting an Irish employment permit approved can feel like the finish line.

But what if the job you actually do is different from the job stated in your application?

What if your permit was approved based on one salary, but you are being paid something different?

Or your working hours and duties change after approval?

These differences can matter.

The Workplace Relations Commission (WRC) can inspect workplaces and check whether employers are complying with Irish employment law. For employment permit holders, what inspectors find in the workplace can also become relevant to employment permit compliance.

What Is a "Work of Convenience"?

You may hear people informally use the phrase "work of convenience."

This is not an official employment permit term.

It can describe a situation where an employment permit is obtained for one occupation, but the employee is actually performing a substantially different role.

For example:

Permit: Job A

Reality: Job B

Having an approved employment permit does not mean the job written on the application can simply exist on paper while the employee performs a completely different role.

Your employment permit is connected to the employment for which it was granted.

Who Is the WRC?

The Workplace Relations Commission (WRC) is responsible for inspecting workplaces and enforcing various areas of Irish employment law.

For employment permit holders, WRC inspectors can also check compliance with requirements under Ireland's employment permits legislation.

In 2024, the WRC completed 5,156 inspections.

Of those inspection cases, 2,108 involved breaches of employment law, and approximately €2.15 million in unpaid wages was recovered.

This is why employment permit compliance should not be treated as something that ends once your application is approved.

Can a WRC Inspection Be Unannounced?

Yes.

A WRC inspection does not always have to come with advance warning.

Inspectors have statutory powers that can include entering workplaces at reasonable times, requesting relevant records, inspecting documents and interviewing employers and employees.

This means employers and permit holders should be compliant throughout the employment relationship, not only when they know an inspection is coming.

What Can Be Checked?

Depending on the inspection and applicable legislation, employment records can include information about:

  • job classification and duties
  • salary and payroll
  • payslips
  • working hours
  • terms of employment
  • commencement dates
  • holiday and public holiday entitlements
  • other statutory employment records

For an employment permit holder, these records can help show what is actually happening at work.

Your Permit Says €40,904. Are You Actually Being Paid It?

Imagine an employment permit was granted based on remuneration of €40,904.

The application may say €40,904, but payroll records and payslips can show what the employee is actually receiving.

The same applies to working hours.

If the contract says one thing while timesheets and workplace records consistently show something different, that can raise compliance issues.

And the same principle applies to the job itself.

What was presented on paper should match the genuine employment taking place in practice.

What If Your Job Changes After Approval?

This is where permit holders need to be careful.

Do not assume that because you are staying with the same employer, you can automatically move into any other occupation under the same employment permit.

A change in your:

  • occupation
  • job duties
  • employer
  • remuneration
  • hours or other important employment conditions

may have employment permit implications.

There are specific rules that can apply to changes of employer, promotions and changes in employment depending on your permit type and circumstances.

Check the rules before assuming your existing permit covers the new arrangement.

Can Your Employment Permit Be Revoked?

An employment permit can be revoked in circumstances set out in the Employment Permits Act 2024.

Section 40 provides the Minister with powers to revoke an employment permit on specified grounds.

These include certain situations involving non-compliance with the Act, fraud or misrepresentation, and information provided in relation to an application being false or misleading in a material respect.

There is an important distinction here.

The WRC does not simply revoke your employment permit during an inspection.

A WRC inspection may uncover breaches or information relevant to employment permit compliance.

The statutory power to revoke an employment permit rests with the Minister under the Employment Permits Act 2024.

"But My Permit Was Already Approved"

Approval does not make false, misleading or non-compliant arrangements acceptable afterwards.

Your employment permit was granted based on information and circumstances presented as part of the application.

If the reality of the employment does not match what should be happening, the fact that the permit was previously approved does not automatically protect the arrangement.

This is why compliance continues after approval.

What Can Happen If the WRC Finds a Breach?

The consequences depend on what inspectors find and which legislation applies.

WRC enforcement can include measures such as compliance notices, fixed payment notices and prosecution in relevant circumstances.

In 2024, the WRC reported 175 prosecutions and 141 successful outcomes

A WRC inspection does not automatically mean your employment permit will be revoked.

The outcome depends on the particular breach, the facts of the case and the legislation involved.

A Real Employment Permit Decision Can Depend on WRC Findings

This is not purely theoretical.

Employment permit decisions can take account of information discovered through workplace compliance checks.

If an inspection raises concerns about whether the employment or position genuinely exists as presented, those findings can become relevant when the Department considers an employment permit application or review.

This is why what happens in the workplace matters just as much as what was written in the application.

What Should Permit Holders Keep Checking?

After your employment permit is approved, continue checking:

Job duties: Are you actually performing the role connected to your permit?

  • Occupation: Does your real occupation still match the permitted employment?
  • Employer: Are you working under the correct employment arrangement?
  • Salary: Are you actually receiving the agreed remuneration?
  • Hours: Do your working hours match your records?
  • Payslips: Are your payslips accurate?
  • Contract: Does your contract reflect what is happening in practice?
  • Conditions: Are your employment conditions compliant?

If something significant changes, check whether action is required.

Do not simply allow your job to change quietly and assume the original permit will continue to cover everything.
